4. STEP-BY-STEP EXECUTION & FILING GUIDE

STEP 1: BRACKETED FIELD COMPLETION

  1. Open the document in Microsoft Word or Google Docs.
  2. Use the Find and Replace (Ctrl+H) function to locate all square brackets [...].
  3. Ensure the Effective Date is the date you intend the Attorney's powers to begin.
  4. Specify Compensation clearly to avoid future litigation between heirs and the Attorney.

STEP 2: VERIFY SIGNATORY AUTHORITY

  1. The Grantor must be mentally capable at the time of signing (able to understand what they own and the power they are giving).
  2. Ensure the Attorney is willing to act and understands their fiduciary duties under the Substitute Decisions Act.

STEP 3: FORMAL EXECUTION (SIGNING)

  1. Physical Presence: The Grantor and both witnesses must be in the same room physically. (Note: Ontario allows virtual witnessing under specific conditions via the Accelerating Access to Justice Act, 2021, but physical signing is the gold standard for enforceability).
  2. Order of Signing: The Grantor signs first, then Witness 1, then Witness 2.
  3. Digital Signatures: If using DocuSign/Adobe Sign, ensure the platform generates a "Certificate of Completion" that logs the IP addresses and timestamps of all parties.

STEP 4: RECORD RETENTION AND FILING

  1. Originals: Keep the original document in a fireproof safe or with your lawyer.
  2. Certified Copies: Have a lawyer or notary public create several "Certified True Copies." Banks and land registry offices usually require a certified copy to recognize the Attorney's authority.
  3. Notification: Provide a copy to your bank, investment advisor, and the appointed Attorney.
  4. No Public Registry: Note that Ontario does not have a central registry for Powers of Attorney; therefore, communication of its existence to relevant institutions is the responsibility of the Grantor/Attorney.
