6. STEP-BY-STEP EXECUTION & FILING GUIDE

  1. Field Completion: Open this document in Microsoft Word or Google Docs. Use the [Find and Replace] function to locate all bracketed text (e.g., [Principal Full Legal Name]) and input the specific legal data.
  2. Signatory Verification: Ensure the Principal is mentally competent at the time of signing. In Pennsylvania, the Agent cannot serve as a witness.
  3. Physical Execution:
    • The Principal must sign in the presence of two (2) adult witnesses and a Notary Public.
    • The witnesses must sign in the presence of the Principal and the Notary.
    • The Notary must affix their official seal.

  5. Digital Execution: While Pennsylvania allows for electronic signatures (UETA), many financial institutions still require "wet ink" signatures and notarization for Real Estate transactions. It is recommended to execute physical originals.
  6. Record Retention & Filing:
    • The original should be kept in a secure, fireproof location.
    • Certified copies should be provided to the Principal’s bank, primary physician, and the County Recorder of Deeds if real estate transactions are anticipated.
    • Maintain a "Master Control Log" of all entities that have received a copy to facilitate easy revocation if necessary.
