V. STEP-BY-STEP EXECUTION & FILING GUIDE

  1. Preparation: Open this document in Microsoft Word or Google Docs. Use the Find and Replace (Ctrl+H) function to replace all bracketed items (e.g., [Principal Full Legal Name]) with your specific information.
  2. Review: Ensure the compensation terms in Section III, Clause 2 are accurately reflected. If the Agent is a family member serving for free, explicitly state "shall not be compensated."
  3. Physical Execution:
    • Location: New Jersey law requires the Principal to sign in the presence of a Notary Public.
    • Witnesses: While not strictly required for a financial POA in NJ (provided it is notarized), it is institutional best practice to have two (2) disinterested witnesses sign as well.
  4. Digital Signature: If using DocuSign or Adobe Sign, ensure the "Notary" module is enabled (Digital Notarization). Note: For real estate transactions, many NJ County Clerks still require "wet ink" signatures for recording.
  5. Recording:
    • If the Agent will manage Real Estate, take the original signed and notarized document to the County Clerk’s Office in the county where the property is located to have it recorded.
  6. Distribution: Provide certified copies to the Agent, the Principal's bank, and the Principal's accountant.
  7. Retention: The original should be kept in a fireproof safe or with the Principal’s legal counsel. Do not store it in a safe deposit box that the Agent cannot access.
