5. STEP-BY-STEP EXECUTION & FILING GUIDE

  1. Preparation: Open this document in a word processor (Microsoft Word or Google Docs). Replace all bracketed text (e.g., [Principal Full Legal Name]) with the specific legal details of the parties involved. Ensure the "Compensation" clause reflects the actual agreement.
  2. Review: The Principal must review the document in its entirety. It is recommended that the Principal and Agent consult with independent legal counsel to ensure specific estate planning goals are met.
  3. Signature Requirement: The Principal must sign the document in the presence of a Notary Public. While Missouri law primarily requires the Principal's signature, having the Attorney-in-Fact sign the "Acceptance of Appointment" section is a corporate best practice to demonstrate the agent's consent to fiduciary duties.
  4. Notarization: Take the unsigned document to a Notary Public. The Notary must witness the Principal’s signature and affix their official seal.
  5. Digital Execution (Optional): If using DocuSign or Adobe Sign, ensure the platform complies with Missouri’s Uniform Electronic Transactions Act (UETA). Note: Many financial institutions still require "wet ink" notarized signatures for real estate transactions.
  6. Distribution: Provide original copies or certified copies to:
    • The Attorney-in-Fact.
    • The Principal’s bank and financial institutions.
    • The County Recorder of Deeds (required if the Attorney-in-Fact will be transferring real estate).
  7. Record Retention: Store the original document in a secure location, such as a fireproof safe or with the Principal's legal counsel. Do not store the only copy in a safe deposit box that the Agent cannot access.
