V. STEP-BY-STEP EXECUTION & FILING GUIDE
- Field Completion: Open this document in a word processor (Microsoft Word or Google Docs). Use the "Find and Replace" function to locate all bracketed terms (e.g.,
[Principal Full Legal Name]) and replace them with the correct legal identities and addresses. - Initial Special Powers: In Section III, Clause 3 ("Hot Powers"), the Principal must manually initial each specific power they wish to grant. If left blank, the Agent will NOT have these powers under Kentucky law.
- Signatory Authority: The Principal must sign the document in the presence of a Notary Public.
- Notarization (Critical): Under KRS 457.050, a signature on a power of attorney is presumed to be genuine if the principal acknowledges the signature before a notary public. This is required for the document to be recorded.

- Financial Institutions: Provide a certified copy to all banks and investment firms where the Principal holds accounts.
- County Clerk: If the Agent is intended to sell or transfer Real Estate, the original document MUST be recorded in the County Clerk’s office in the county where the real estate is located.
