3.1. DURABILITY & EFFECTIVENESS
This Power of Attorney shall be "Durable." It shall become effective immediately upon execution and shall not be affected by the subsequent disability, incompetence, or incapacity of the Principal. 5. STEP-BY-STEP EXECUTION & FILING GUIDE
- Information Entry: Open this document in a word processor. Search and replace all bracketed fields (e.g.,
[Principal Full Legal Name]) with the accurate, legal names and addresses as they appear on government-issued identification. - Review: The Principal must review the "Enumerated Financial Powers" section. If specific powers (like the power to make gifts) should be restricted, they must be struck through and initialed prior to notarization.
- Notarization (Critical): Under K.S.A. 58-652, a Kansas Power of Attorney must be acknowledged before a Notary Public. The Principal must sign in the presence of the Notary.
- Agent Signature: While Kansas law focuses on the Principal's signature, having the Agent sign the "Acceptance of Appointment" is best practice for institutional recognition (banks/brokers).
- Digital Execution: If using DocuSign or Adobe Sign, ensure the platform provides a "Notary Seal" integration that complies with Kansas's Electronic Transactions Act.
- Filing & Distribution:
- Original: Keep the original in a fireproof safe or with legal counsel.
- Recordation: If the Agent will manage real estate, a copy of this POA should be filed with the Register of Deeds in the Kansas county where the property is located.
- Financial Institutions: Provide a certified copy to the Principal's banks and investment firms to put the Agent on record.
- Revocation: To revoke this document, the Principal must execute a written Revocation of Power of Attorney and provide copies to all third parties who previously received the original.
