6. STEP-BY-STEP EXECUTION & FILING GUIDE
- Document Customization: Download the document into Microsoft Word or Google Docs. Locate all bracketed text (e.g.,
[Client Full Legal Name],[Property Full Legal Address],[Amount in USD]) and replace them with accurate, verified legal data. Ensure exact consistency with the purchase contract, loan agreement, and title commitment. - Title Company & Escrow Review: Transmit a draft copy of this completed Special Power of Attorney to the designated closing officer, settlement agent, and title insurance underwriter at least seven (10) business days prior to closing to secure formal underwriting pre-approval. Certain lenders and underwriters mandate specific statutory language that must not be altered.
- Signatory Verification: Verify that the Principal possesses the legal capacity to execute the instrument and that the Attorney-in-Fact is legally competent and authorized to act.
- Execution and Notarization: This document must be signed by the Principal in the physical presence of a licensed Notary Public (and witnesses, if mandated by state law). The Attorney-in-Fact should also execute the Acceptance of Appointment section before a notary if required by local recording standards.
- Digital Signature Protocol: If physical appearance before a notary is impractical, verify whether the governing jurisdiction permits Remote Online Notarization (RON) utilizing tamper-evident digital certificate technologies (e.g., DocuSign, Notarize, Adobe Sign) compliant with ESIGN and UETA standards. Note that county recorders frequently reject electronic stamps or require specific paper-recording exemplars.
- County Recording: Because this instrument affects real property title and conveyance, file and record the fully executed, notarized original Power of Attorney in the Land Records / Registry of Deeds of the County where the Property is situated prior to or concurrently with the closing deed.
- Record Retention: Retain fully executed original copies in the secure document management systems of the closing law firm, the Principal, and the Attorney-in-Fact for a minimum of seven (7) years post-closing, or in accordance with state statute of limitations for real estate transactions.
