5. STEP-BY-STEP EXECUTION & FILING GUIDE
- Document Customization: Download this template into Microsoft Word or Google Docs. Locate all bracketed placeholder text (e.g.,
[Principal Full Legal Name],[State / Country Jurisdiction]) and replace them with the accurate, legal names and details of the participating parties. - Statutory Audit: Cross-reference the financial and healthcare clauses with the current probate, health, and safety codes of your specific jurisdiction (
[State / Country Jurisdiction]). Ensure local mandatory disclosure warnings are appended if required by state law. - Signatory Verification: Verify that the Principal possesses clear legal capacity and testamentary capacity at the time of execution.
- Witness and Notary Coordination: Arrange for the physical presence of two disinterested witnesses (individuals who are not named as agents, beneficiaries, or related by blood or marriage, depending on local statutes) and a licensed Notary Public.
- Digital or Wet-Ink Execution: Execute the document via traditional wet-ink signatures in the presence of the witnesses and notary. If executing digitally (e.g., via DocuSign or Adobe Sign), ensure the platform complies with the Electronic Signatures in Global and National Commerce Act (E-SIGN) and the Uniform Electronic Transactions Act (UETA); note, however, that remote online notarization (RON) laws vary widely for powers of attorney.
- Record Retention & Distribution:
- Store the original, fully executed wet-ink document in a secure, fireproof home safe or institutional vault.
- Provide authenticated copies to the Primary Agent, Successor Agent, primary healthcare providers (to be placed in the medical file), and key financial institutions (banks, wealth management advisors).
