5. STEP-BY-STEP EXECUTION & FILING GUIDE
Step 1: Document Customization & Review
- Open the document template in Microsoft Word, Google Docs, or an authorized legal document assembly platform.
- Locate all bracketed text fields (e.g.,
[Parent/Guardian 1 Full Legal Name],[State],[Effective Date]) and replace them with accurate, verified legal data. Do not leave any placeholder brackets uncompleted. - Verify that the chosen effective dates and expiration terms comply with local state statutory limitations for minor powers of attorney (many jurisdictions cap these at 6 or 12 months).
Step 2: Signatory & Capacity Verification
- Confirm that the Principals executing this document hold lawful, undisputed custody of the Minor. If there is a custody decree resulting from a divorce or separation, review the decree to ensure that delegating authority does not violate court orders.
- Confirm that the designated Attorney-in-Fact is an adult of sound mind who consents to the fiduciary duties imposed by this instrument.
Step 3: Execution and Formalities (Witnesses & Notarization)
- Do not sign this document in isolation. Printing and signing without formal observation may invalidate the instrument.
- Gather the Principals, the Attorney-in-Fact, two disinterested adult witnesses (individuals who are not related to the parties and not named as agents), and a licensed Notary Public.
- Execute the signature blocks in the physical presence of the Notary Public and witnesses, ensuring all government-issued photo identifications are verified.
- Ensure the Notary Public completes the jurat/acknowledgment block and applies their official seal or stamp.
Step 4: Digital Execution (Alternative via DocuSign / Adobe Sign)
- If executing via a digital signature platform compliant with the ESIGN Act and UETA:
- Upload the finalized PDF document to the platform.
- Route signature fields securely to the Principals and Attorney-in-Fact.
- Crucial Note: Ensure that remote online notarization (RON) is utilized if state law permits electronic notarization, as simple electronic signatures without notarization are frequently rejected by medical and school institutions.
Step 5: Distribution & Record Retention
- Primary Copies: Provide certified physical copies or digitally verified originals to the Attorney-in-Fact. The Attorney-in-Fact should carry a copy or digital access card when traveling with or caring for the Minor.
- Institutional Filings: Deliver physical or certified electronic copies to:
- The Minor's primary and specialty healthcare providers, pediatrician, and local hospital network.
- The administrative office of the Minor's school, daycare, or educational institution.
- Archival Retention: The Principals and Attorney-in-Fact must retain the fully executed master original in a secure, accessible physical and digital archive for the duration of the agreement plus a minimum statute of limitations period (typically 3 to 7 years post-expiration).
