5. STEP-BY-STEP EXECUTION & FILING GUIDE
- Document Preparation: Download this template into Microsoft Word or Google Docs. Replace all bracketed text (e.g.,
[Principal Full Legal Name],[Effective Date], etc.) with the accurate legal information. Ensure no brackets remain unfilled. - Review Authority: Verify that both the Principal and Agent possess the legal capacity to enter into a contract and execute agency powers under Alaska law.
- Digital or Physical Execution: While digital signature platforms (such as DocuSign or Adobe Sign) are permissible for many business contracts, Powers of Attorney affecting real estate, banking, or formal legal filings frequently require wet-ink signatures and physical notarization under Alaska state practice. Check with receiving financial institutions or title companies before utilizing electronic signatures.
- Notarization: Both the Principal (upon execution) and the Agent (upon acceptance) must appear before a licensed Notary Public in the State of Alaska (or a valid jurisdiction where execution occurs) to complete the formal acknowledgment blocks.
- Recording and Record Retention:
- If this Power of Attorney is to be used for real estate transactions, it must be recorded in the Alaska District Recorder’s Office for the recording district in which the property is located.
- The Principal should retain the original wet-ink document in a secure, accessible location (such as a fireproof safe or safety deposit box).
- The Agent should be provided with certified copies of the original instrument to present to financial institutions, healthcare providers, or business entities as proof of authority.
