Professional Photography Services Agreement

Instructions for Use

• Provide a copy of this document to the client well in advance of the session date to ensure they have adequate time to review and sign.
• Retain a fully executed digital or physical copy of this agreement for your records for at least three years following the completion of the session.

1. Parties and Session Details

2. Retainer and Payment

The Client shall pay the Non-Refundable Retainer upon signing this Agreement to secure the requested date and time. The remaining balance shall be due [Number] days prior to the session date. If the final balance is not paid by the due date, the Photographer reserves the right to cancel the session and retain the deposit as liquidated damages.

3. Cancellation and Rescheduling

If the Client cancels the session, the Non-Refundable Retainer is forfeited. If the Photographer is unable to perform the duties due to unforeseen circumstances (e.g., illness, emergency), the Photographer will provide a full refund of all monies paid, and the liability shall be limited to the total amount paid under this Agreement. Rescheduling due to inclement weather shall be at the sole discretion of the Photographer.

4. Image Delivery and Editing

6. Liability and Indemnification

The Client agrees to hold the Photographer harmless from any injury or damage that may occur during the session, except in cases of gross negligence. The Photographer is not responsible for the cooperation of subjects (including children or pets) during the session.

7. Entire Agreement

This document constitutes the entire agreement between the parties and supersedes any prior understandings. Any modifications must be made in writing and signed by both parties.
