Media Consent and Release Agreement

Parties and Definitions

This Agreement is entered into on [Date] by and between:

The Media: Any and all photographs, video recordings, audio recordings, or other digital or physical reproductions of the Subject’s likeness, voice, or performance captured by the Producer during [Project Name/Event Name] occurring on [Date of Recording].

Operative Clauses

1. Grant of Rights: The Subject hereby grants the Producer, their successors, licensees, and assigns, the irrevocable, perpetual, worldwide, royalty-free right and license to use, reproduce, distribute, display, edit, and modify the Media in any and all media formats now known or hereafter developed, including but not limited to social media, websites, print advertising, and broadcast.

2. Waiver of Approval: The Subject acknowledges that they have no right to inspect or approve the finished product, the advertising copy, or any other matter that may be used in connection with the Media. The Subject waives any right to royalties or other compensation arising from or related to the use of the Media.

3. Release and Indemnity: The Subject hereby releases and discharges the Producer from any and all claims, demands, or causes of action that the Subject may have now or in the future arising out of or in connection with the use of the Media, including but not limited to claims for defamation, invasion of privacy, or rights of publicity.

4. Capacity: The Subject represents that they are [ ] 18 years of age or older and have the full legal capacity to sign this agreement. [ ] If the Subject is under 18, a parent or legal guardian must sign below.

5. Governing Law: This agreement shall be governed by the laws of the state of [State Name], without regard to its conflict of law principles.
