The Agent has the right to receive "Protected Health Information" (PHI) and medical records. (b) Work Product/Data Ownership: Any logs, diaries, or medical record summaries maintained by the Agent during the term of this agreement shall be considered "Work Made for Hire" and shall be the sole property of the Principal. The Agent hereby assigns all rights, title, and interest in such data to the Principal.
2.5 MUTUAL CONFIDENTIALITY
(a) Definition: "Confidential Information" includes the Minor’s medical history, diagnoses, treatments, and any personal family information shared with the Agent. STEP-BY-STEP EXECUTION & FILING GUIDE
- Field Completion: Open this document in Microsoft Word or Google Docs. Use the
[Bracketed]fields to input specific names, addresses, and dates. Ensure the "Governing Jurisdiction" matches the state where the child resides. - Verify Authority: Ensure the Principal has sole or joint legal custody. If joint custody exists, it is best practice (though not always legally required) for both parents to sign as Principals.
- Witnessing: Most jurisdictions require two disinterested witnesses. A "disinterested" witness is someone not related to the child and not named as the Agent.
- Notarization: This document must be signed in the presence of a Notary Public. This is the standard for medical facilities to verify the authenticity of the signature.
- Digital Execution: If using DocuSign or Adobe Sign, ensure the platform provides a "Certificate of Completion" that includes IP addresses and timestamps. Note: Some hospitals still require "wet ink" notarized originals; check with your local health system.
- Distribution & Retention:
- Keep the Original in a secure location.
- Provide a Certified Copy to the Agent.
- Provide copies to the Minor's primary care physician (PCP), school nurse, and any preferred local hospitals.
- Store a digital copy on a cloud service accessible by the Agent in emergencies.
- Renewal: Note the expiration date. Re-execute a new document at least 30 days prior to expiration to ensure continuity of care.
