1.4 Definitions & Interpretation

1. TERM OF AGREEMENT

4.1 The Rental Provider must give the Renter two copies of the Condition Report signed by the Rental Provider (or Agent) specifying the state of repair and condition of the Premises on or before the date the Renter enters into occupation. 4.2 The Renter must complete, sign, and return one copy of the Condition Report to the Rental Provider or Agent within 3 business days after taking possession of the Premises.

5. RENTAL PROVIDER’S OBLIGATIONS & STATUTORY DUTIES

5.1 Fitness for Habitation: The Rental Provider must ensure that the Premises comply with the rental minimum standards prescribed under the Residential Tenancies Regulations 2021 (Vic) on the day the Renter enters into occupation (including lockability, vermin proofing, fixtures, lighting, ventilation, heating, and structural soundness). 5.2 Urgent Repairs: The Rental Provider must ensure arrangements are in place for urgent repairs (as defined in the Act) to be undertaken promptly. 5.3 Non-Urgent Repairs: The Renter must give the Rental Provider written notice of any non-urgent repairs required.

6. RENTER’S OBLIGATIONS

6.1 Use of Premises: The Renter shall use the Premises primarily as a private residence. 6.2 Damage and Cleanliness: The Renter must keep the Premises reasonably clean and undamaged, and notify the Rental Provider of any damage as soon as practicable. 6.3 Quiet Enjoyment / Nuisance: The Renter must not use, or allow use of, the Premises in a manner that causes a nuisance or substantially interferes with the reasonable peace, comfort, or privacy of occupiers of neighbouring premises. 6.4 Subletting / Assignment: The Renter must not assign or sub-let the whole or any part of the Premises without the written consent of the Rental Provider, which consent shall not be unreasonably withheld pursuant to the Act.

7. MODIFICATIONS & FIXTURES

7.1 Pursuant to Section 64B of the Act, the Renter may, without the Rental Provider’s consent, make certain minor modifications (e.g., picture hooks, command strips, furniture anchors, LED light globes) provided the modifications do not involve structural changes and the premises are restored to their original condition upon vacating (fair wear and tear excepted). 7.2 All other modifications require the prior written consent of the Rental Provider.

8. ACCESS & INSPECTIONS

8.1 The Rental Provider or Agent may enter the Premises for inspection, valuation, or showing prospective renters/purchasers, strictly subject to providing written notice between 7 and 14 days prior to entry, and no more than once every 6 months (for general inspections), or as otherwise permitted under Section 86 of the Act.

9. NOTICE TO VACATE & TERMINATION

9.1 Termination of this Agreement by either party must be executed strictly in accordance with the mandatory notice periods and grounds set out in the Residential Tenancies Act 1997 (Vic). No "without grounds" notices to vacate may be issued at the end of an initial fixed-term lease unless permitted by specific transitional or legislative provisions.
