2. DEFINITIONS & INTERPRETATION
In this Agreement, unless the context clearly indicates a contrary intention:
- "Day" means any day other than a Saturday, Sunday, or public holiday in South Africa.
- "Deposit" means the monetary security bond paid by the Tenant in terms of Clause 5.
- "Lease Period" means the duration of this Agreement set out in Clause 3.
- "Municipal Charges" means charges levied by the local authority for water, electricity, refuse removal, and sewerage.
- "RHA" means the Rental Housing Act 50 of 1999, as amended.
- "CPA" means the Consumer Protection Act 68 of 2008.
3. DURATION AND LEASE PERIOD

- 3.2.3. Upon expiry, the lease will automatically continue on a month-to-month basis on the terms specified herein, unless explicitly renewed for a further fixed period or terminated by either party giving 1 (one) calendar month's written notice.
4. RENT AND PAYMENT TERMS

6. MUNICIPAL UTILITIES & SERVICE CHARGES

7. INSPECTIONS AND MAINTENANCE

- 7.1.2. Outgoing Inspection: Within 3 (three) days prior to vacating, the parties must jointly conduct an outgoing inspection to determine damages caused during the tenancy.
7.2. Landlord Obligations:
- Maintain the structural integrity of the Premises (roof, exterior walls, main plumbing, structural wiring).
- Maintain the Premises in a condition fit for residential occupation.
7.3. Tenant Obligations:
- Maintain the interior of the Premises in a clean, hygienic, and undamaged condition.
- Promptly replace broken light bulbs, fuses, and minor consumables.

8. USE OF PREMISES & CONDUCT RULES

9. BREACH AND CANCELLATION

- 9.1.1. CPA Covered Lease: The Landlord shall issue a written notice allowing 20 (twenty) business days to remedy the default.
- 9.1.2. Non-CPA Lease: The Landlord shall issue a written notice allowing 7 (seven) calendar days (or 20 business days as per RHA regulations) to remedy the default.
9.2. Termination upon Default: If the Tenant fails to remedy the default within the specified period, the Landlord may:
- Cancel this Agreement immediately without further notice;
- Retake possession of the Premises subject to statutory eviction proceedings under the Prevention of Illegal Eviction from and Unlawful Occupation of Land Act 19 of 1998 (PIE Act);
- Claim outstanding rent, damages, legal costs, and reasonable penalties.
9.3. Legal Costs: The defaulting party shall be liable for all legal costs incurred by the non-defaulting party in enforcing this Agreement on an attorney-and-own-client scale.
10. PROTECTION OF PERSONAL INFORMATION (POPIA)
10.1. Consent: The Tenant hereby grants explicit consent to the Landlord and/or managing agent to collect, process, and retain personal information for the purposes of:
- Processing tenant applications and conducting credit checks through registered Credit Bureaus;
- Managing tenancy and enforcing contractual obligations;
- Exchanging information with utility providers, law enforcement, or debt collection agencies where legally mandated.
10.2. Data Rights: Information will be stored securely and handled in accordance with the provisions of POPIA.
11. DOMICILIUM CITANDI ET EXECUTANDI (NOTICES)
11.1. The parties select their respective physical addresses listed in Section 1 as their domicilium citandi et executandi for all purposes under this Agreement, including legal service of summons and notices.
11.2. Written notice sent via registered post or delivered by hand shall be deemed received on the date of delivery. Written notices sent via confirmed Email shall be deemed received on the business day following transmission.
12. GENERAL TERMS & JURISDICTION
12.1. Whole Agreement: This document contains the entire agreement between the parties. No variation, modification, or consensual cancellation shall be valid unless reduced to writing and signed by both parties.
12.2. Indulgence: No latitude, extension of time, or indulgence granted by the Landlord shall operate as a waiver or novation of rights.
12.3. Severability: If any provision of this Agreement is rendered invalid or unenforceable by a court of law, such invalidity shall not affect the remaining terms, which shall remain in full force and effect.
12.4. Jurisdiction: The parties consent to the non-exclusive jurisdiction of the Magistrate’s Court having jurisdiction over the Premises, notwithstanding that any claim or dispute may otherwise exceed such court's monetary limit.
