3. OPERATIVE CLAUSES & TERMS
1. INTERPRETATION & DEFINITIONS
1.1. "Act" means the Rental Housing Act 50 of 1999, as amended.
1.2. "CPA" means the Consumer Protection Act 68 of 2008.
1.3. "Deposit" means the financial sum paid by the Tenant as security for the due fulfillment of all obligations under this Agreement.
1.4. "Interest" means interest calculated at the prime overdraft rate charged by the Landlord’s primary commercial bank from time to time, plus two percent (2%).
1.5. "Rental" means the monthly consideration payable by the Tenant to the Landlord for the use and occupation of the Property.
2. DURATION
2.1. This Agreement shall commence on [Lease Commencement Date] ("Commencement Date") and shall endure for a fixed period until [Lease Termination Date] ("Termination Date"), whereupon it shall terminate without requiring notice, subject to Clause 3.
2.2. 3. RENTAL & PAYMENT TERMS

4. DEPOSIT

4.3. The Landlord shall, within fourteen (14) days of the restoration of the Property to the Landlord, refund the Deposit to the Tenant, reduced by any reasonable cost incurred to repair damage to the Property, outstanding utility charges, or unpaid rentals.
5. JOINT INSPECTIONS
5.1. The Landlord (or agent) and the Tenant shall inspect the Property jointly prior to the Commencement Date to compile a list of defects or damage, which list shall be annexed hereto as Schedule "A".
5.2. If the Landlord fails to inspect the Property in the presence of the Tenant on the Commencement Date, the Property is deemed to be in a good and proper state of repair, shifting the onus of proof regarding pre-existing defects to the Tenant.
5.3. A joint outgoing inspection shall be conducted not less than three (3) days prior to the expiration of this Agreement to determine any damages incurred during the tenancy.
6. USE OF THE PROPERTY
6.1. The Property shall be used exclusively for residential purposes by the Tenant and the following permitted occupants: [List Names of Other Occupants or State "None"].
6.2. The Tenant shall not sub-let the Property, cede this Agreement, or assign any rights hereunder without the prior written consent of the Landlord.

8. UTILITIES & SERVICES
8.1. The Tenant shall be liable for the consumption costs of electricity, water, gas, refuse removal, and sanitation services supplied to the Property, invoiced separately or in addition to the Rental.
8.2. Pre-paid utility meters, where installed, shall be maintained by the Tenant at their sole cost.
9. BREACH & TERMINATION
9.1. If the Tenant commits a material breach of this Agreement (including failure to pay Rental on due date) and fails to remedy such breach within twenty (20) business days (or seven (7) business days in the case of non-payment of rent, subject to statutory notices) after receipt of written notice requiring them to do so, the Landlord shall be entitled, without prejudice to any other rights under law, to:
- 9.1.1. Cancel this Agreement, retake possession of the Property, and claim damages; or
- 9.1.2. Claim immediate specific performance of all obligations.
9.2. Should the Tenant cancel this Agreement prematurely prior to the expiry of the fixed term without cause, the Landlord shall be entitled to claim a reasonable cancellation penalty in accordance with Regulation 5 of the CPA.
10. JURISDICTION & DOMICILIUM
10.1. The parties choose their respective physical addresses specified in Clause 2 as their domicilium citandi et executandi for all purposes arising from this Agreement.
10.2. The parties consent to the jurisdiction of the Magistrates' Court having jurisdiction over the Property in respect of any legal proceedings, notwithstanding that the quantum of the claim may exceed the ordinary jurisdiction of such court.
