3. OPERATIVE CLAUSES & TERMS
3.1 Lease Period
- The Landlord lets and the Tenant hires the Premises for a fixed period commencing on the Rental Commencement Date and expiring on the Rental Termination Date, without notice unless otherwise agreed in writing.
- Should the Tenant remain in occupation after the Termination Date without a renewal agreement, a month-to-month tenancy shall arise under the same terms and conditions, subject to a revised rental rate as determined by the Landlord upon one (1) calendar month's written notice.
3.2 Rental, Payment Terms, and Escalation
- The Monthly Rental is payable monthly in advance, without deduction or set-off, on or before the first (1st) day of each calendar month.
- Payment must be made via Electronic Funds Transfer (EFT) into the following designated bank account:

3.3 Security Deposit
- The Tenant shall pay the Deposit to the Landlord upon signature of this Agreement.
- The Landlord shall hold the Deposit in an interest-bearing account with a financial institution, with interest accruing to the Tenant at a rate not less than the rate applicable to a savings account managed by that financial institution.
- The Deposit, together with accrued interest, shall be refunded to the Tenant within fourteen (14) business days of the expiration of this Agreement, subject to the deduction of:
- Any reasonable costs incurred by the Landlord in repairing damage to the Premises caused by the Tenant (fair wear and tear excepted);
- Any arrears in rental, utility charges, or other monies due under this Agreement.
3.4 Joint Inspection of Premises
- In-going Inspection: The Landlord and Tenant shall jointly inspect the Premises prior to occupation on

A joint inspection list shall be annexed hereto as Annexure A. - Out-going Inspection: The Landlord and Tenant shall jointly inspect the Premises within three (3) days prior to the expiration of this Agreement to determine any damages incurred during the tenancy.
- Failure by the Landlord to inspect the Premises in the presence of the Tenant shall be deemed an acknowledgment by the Landlord that the Premises are in a good and proper state of repair.
3.5 Use of Premises
- The Premises shall be used exclusively for residential purposes by the Tenant and the following authorized occupants:

- Tenant Obligations: The Tenant shall, at their own expense, maintain the interior of the Premises (including interior walls, flooring, windows, fixtures, and fittings) in good order and condition, fair wear and tear excepted.
- The Tenant shall not make any structural alterations, additions, or improvements to the Premises without the Landlord's explicit written consent.
3.7 Breach
- If the Tenant fails to pay the Monthly Rental or any other amount due on the due date, or commits any other breach of this Agreement, the Landlord shall give the Tenant twenty (20) business days' written notice to remedy such breach (pursuant to the Consumer Protection Act, if applicable, or general contractual terms).
- If the Tenant fails to remedy the breach within the stipulated notice period, the Landlord shall be entitled, without prejudice to any other rights under law, to:
- Cancel this Agreement, eject the Tenant, and retake possession of the Premises; and/or
- Claim immediate payment of all arrear rentals and damages for future loss of rental for the remainder of the lease term.
3.8 Domicilium Citandi et Executandi
The Parties choose their respective physical addresses set out in Clause 2 as their domicilium citandi et executandi for all purposes arising out of or in connection with this Agreement.
