1. OFFICIAL NOTICE & DISCLAIMER

6. COVENANTS & OPERATIONAL RULES

6.1 Maintenance and Repair

  • Landlord Obligations: The Landlord shall maintain the Premises in a good state of repair and fit for habitation, complying with all health, safety, housing, and maintenance standards under Ontario law.
  • Tenant Obligations: The Tenant shall maintain ordinary cleanliness of the Premises and shall repair damage caused by the willful or negligent conduct of the Tenant, guests, or animals permitted on the property.

6.2 Subletting and Assignment

  • The Tenant may not assign the tenancy or sublet the Premises to another person without the prior written consent of the Landlord, which consent shall not be arbitrarily or unreasonably withheld, pursuant to Section 95 of the RTA.

6.3 Rules and Regulations

6.4 Entry by Landlord

7. DEFAULT & TERMINATION

  • If the Tenant fails to pay rent when due, commits a material breach of this Agreement, or causes undue interference with the enjoyment of the residential complex, the Landlord may issue the applicable notice of termination (e.g., Form N4, N5, N6, or N7) pursuant to the RTA dispute resolution framework governed by the Landlord and Tenant Board (LTB).

8. MISCELLANEOUS PROVISIONS

8.1 Entire Agreement

  • This Agreement, including any attached schedules, constitutes the entire contract between the Landlord and Tenant regarding the Premises. No oral representations, warranties, or understandings shall bind either party.

8.2 Severability

  • If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be severed, and the remaining provisions shall continue in full force and effect.

8.3 Governing Law

  • This Agreement shall be construed, interpreted, and governed exclusively by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
