3. OPERATIVE CLAUSES

3.1. DURATION: This lease shall commence on [Start Date] and terminate on [End Date]. No tacit relocation shall occur; any extension must be agreed upon in writing 60 days prior to termination.

3.2. RENTAL & DEPOSIT:

• Monthly Rental: R [Amount] payable in advance on the [Day] of each month.
• Deposit: A security deposit of R [Amount] (equivalent to [Number] months' rent) shall be held in an interest-bearing account in accordance with the Rental Housing Act.

3.4. MAINTENANCE & REPAIRS: The Landlord is responsible for structural repairs. The Tenant is responsible for the diligent care of the Premises and for any damage caused by negligence or misuse. A joint incoming and outgoing inspection is mandatory.

3.5. BREACH: In the event of non-payment or breach of contract, the Landlord shall provide 20 business days' written notice to remedy the breach. Failure to remedy will result in the Landlord's right to cancel the agreement and/or initiate eviction proceedings pursuant to the Prevention of Illegal Eviction from and Unlawful Occupation of Land Act.

3.6. SUBLETTING: The Tenant shall not sublet the Premises or cede any rights under this agreement without the prior written consent of the Landlord.

3.7. DOMICILIUM CITANDI ET EXECUTANDI: The parties choose their respective addresses provided in Section 2 as their domicilium citandi et executandi for all purposes arising out of this agreement.

5. STEP-BY-STEP EXECUTION GUIDE

1. Mandatory Inspection: Complete a joint "Incoming Inspection" checklist with the Tenant before handover. Photograph all existing defects and attach them as an Addendum A to this agreement.
2. Deposit Handling: Ensure the security deposit is placed in an interest-bearing account as per the Rental Housing Act; provide the Tenant with written proof of the account details and interest earned.
3. Utility Reconciliation: Take a final reading of electricity (prepaid or post-paid meters) and water on the day of occupation, and have both parties initial the meter reading document.
4. Formal Execution: Ensure all pages are initialed by both parties at the bottom, with full signatures on the final execution block to ensure the document is legally binding and admissible in court.
