9. MAINTENANCE, REPAIRS, & ALTERATIONS
- Tenant Obligations: Tenant shall maintain the Premises in a clean, safe, and sanitary condition, and shall promptly notify Landlord of any structural damage, plumbing failures, or required repairs. Tenant shall be responsible for repair costs caused by the negligence or willful misconduct of Tenant, guests, or pets.
- Landlord Obligations: Landlord shall maintain the structural elements, roof, plumbing, heating, and electrical systems in compliance with applicable building codes affecting health and safety (A.R.S. § 33-1324).
- Alterations: Tenant shall not paint, wallpaper, or make any structural alterations, installations, or modifications to the Premises without the prior written consent of Landlord.
10. RIGHT OF ENTRY
Pursuant to A.R.S. § 33-1343, Landlord or Landlord’s agents may enter the Premises to inspect, make necessary repairs, supply agreed services, or exhibit the Premises to prospective purchasers, mortgagees, tenants, workmen, or contractors.
- Notice Requirement: Except in cases of emergency or if impracticable to do so, Landlord shall give Tenant at least two (2) days' notice of intent to enter and shall enter only at reasonable times.
11. DEFAULT & REMEDIES
- Nonpayment of Rent: If Tenant fails to pay rent when due and the default continues for five (5) days after written notice by Landlord specifying payment and the intent to terminate the lease, Landlord may terminate this Agreement pursuant to A.R.S. § 33-1368(B).
- Material Noncompliance: For material noncompliance by Tenant with this Agreement or a material noncompliance with A.R.S. § 33-1341 (affecting health and safety), Landlord may deliver a written notice to Tenant specifying the acts and omissions constituting the breach and that the rental agreement will terminate upon a date not less than ten (10) days after receipt of the notice if the breach is not remedied in ten (10) days.
12. MANDATORY STATUTORY DISCLOSURES (ARIZONA)
- Bed Bug Control (A.R.S. § 33-1319): Tenant acknowledges receipt of the Bed Bug Educational Information provided by Landlord. Tenant warrants that all furnishings and personal property brought into the Premises are free of bed bugs.
- Pool Safety Notice (A.R.S. § 33-1318 / A.R.S. § 36-1681): If the Premises contains a private swimming pool, Tenant acknowledges receipt of the Arizona Department of Health Services pool safety notice. (Strike if inapplicable:
