NOW, THEREFORE, in consideration of the mutual covenants, promises, and valuable consideration contained herein, the receipt and sufficiency of which are hereby acknowledged, the Parties agree as follows:

2. OPERATIONAL DEFINITIONS

For the purposes of this Agreement, the following terms shall have the meanings ascribed below, and such definitions shall apply equally to the singular and plural forms of the terms defined:

3. SUBSTANTIVE TERMS & OBLIGATIONS

3.1 Grant of Lease and Premises

Landlord hereby leases to Tenant, and Tenant hereby takes from Landlord, the Premises, subject to all encumbrances, easements, and restrictions of record. Tenant acknowledges inspection of the Premises and accepts the same in "AS-IS" condition, save for latent defects documented in writing within forty-eight (48) hours of occupancy.

3.2 Lease Term

The Term of this Agreement shall commence on [Lease Start Date] and shall terminate on [Lease End Date] without the necessity of notice from either Party, time being of the essence. Holding over by Tenant after the expiration of the Term shall create a month-to-month tenancy only upon the express written consent of Landlord, subject to a [Multiplier, e.g., 150%] increase in the prevailing Base Rent.

3.3 Rent, Due Dates, and Payment Mechanics

  1. Base Rent: Tenant covenants and agrees to pay to Landlord Base Rent in the monthly amount of [Dollar Amount] ($[00.00]), payable in advance on or before the first (1st) day of each calendar month during the Term.
  2. Method of Payment: Rent shall be paid via electronic portal, automated clearing house (ACH), or cashier's check directed to Landlord’s designated address or payment platform. Cash is strictly prohibited.
  3. Prorated Rent: Rent for any partial calendar month during the Term shall be prorated on a 30-day month basis and shall be paid on or before the Effective Date in the amount of [Dollar Amount] ($[00.00]).

3.4 Security Deposit

  2. Holding and Return: The Security Deposit shall be held in accordance with [Jurisdiction] statutory requirements. Within [Number, e.g., 30] days following the expiration of the Term and vacation of the Premises, Landlord shall return the Security Deposit, less any lawful deductions itemized in writing for unpaid rent, cleaning costs, or physical damages exceeding normal wear and tear.

3.5 Utilities and Services

Tenant shall be directly responsible for arranging and paying all charges associated with utility services to the Premises, including electricity, gas, internet, and cable. Landlord shall provide and pay for [Specify Landlord-paid utilities, e.g., water, trash removal, sewage]. Failure of Tenant to maintain active utility accounts constitutes a material breach of this Agreement.

3.6 Use, Occupancy, and Academic Status

  1. Residential Use: The Premises shall be utilized exclusively for private residential housing purposes by Tenant and the registered occupants listed herein. Commercial operations, subleasing, or short-term rentals (e.g., Airbnb) are strictly prohibited.
  2. Maximum Occupancy: Total occupancy is strictly limited to [Number] registered student occupants.
  3. Academic Status: Tenant warrants that they maintain active enrollment status at an accredited educational institution throughout the Term.

3.7 Maintenance, Repairs, and Alterations

  1. Tenant Obligations: Tenant shall maintain the Premises in a clean, sanitary, and safe condition, promptly reporting any structural, plumbing, or electrical failures to Landlord in writing. Tenant shall bear the cost of repairs rendered necessary by the intentional acts, negligence, or misuse of Tenant, their guests, or invitees.
  2. Prohibited Alterations: Tenant shall not paint, wallpaper, drive nails into walls beyond standard picture hanging, change locks, or install permanent fixtures without the prior express written consent of Landlord.

3.8 Rules and Regulations

Tenant agrees to comply with all written Rules and Regulations established by Landlord, municipal ordinances, and homeowners' association (HOA) bylaws, if applicable. This includes strict adherence to noise curfews, waste disposal protocols, and pet policies.

4. DEFAULT, TERMINATION, AND REMEDIES

4.1 Events of Default

The occurrence of any one or more of the following events shall constitute a material "Default" by Tenant under this Agreement:

  1. Failure of Tenant to pay Base Rent, utility charges, or any other monetary obligation within [Number, e.g., 5] calendar days of its due date.
  2. Failure of Tenant to perform or observe any non-monetary covenant, condition, or rule within this Agreement.
  3. Abandonment or surrender of the Premises prior to the expiration of the Term.
  4. The filing of a petition in bankruptcy by or against Tenant, or the appointment of a receiver for Tenant's assets.
  5. Falsification of information provided on the Tenant Application or Student Enrollment Verification.

4.2 Notice and Cure Periods

Except for failure to pay rent (which requires immediate notice and a [Number, e.g., 5-day] cure period), Landlord shall provide Tenant with written notice specifying the nature of any non-monetary Default. Tenant shall have thirty (30) business days from receipt of such notice to cure the Default. If the Default cannot be reasonably cured within thirty (30) business days due to circumstances beyond Tenant's control, Tenant must initiate cure actions within said period and diligently prosecute the same to completion.

4.3 Landlord Remedies

Upon the occurrence of an un-cured Default, Landlord may, at its sole discretion and without prejudice to any other legal or equitable rights, exercise any of the following remedies:

  1. Termination of Lease: Terminate this Agreement and Tenant's right to possession of the Premises upon proper statutory notice, recovering possession via summary proceedings or unlawful detainer actions.
  2. Acceleration of Rent: Declare all remaining Base Rent for the remainder of the Term immediately due and payable, subject to Landlord's statutory duty to mitigate damages.
  3. Collection of Costs: Recover from Tenant all reasonable legal fees, court costs, collection agency commissions, and administrative fees incurred by Landlord in enforcing the terms of this Agreement.

5. BOILERPLATE LEGAL PROVISIONS

5.1 Severability

If any provision of this Agreement is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable. The remaining provisions of this Agreement shall remain in full force and effect.

5.2 Entire Agreement

This Agreement, together with any attached addenda (including the Student Lease Guaranty and Move-In Inspection Checklist), constitutes the entire agreement between Landlord and Tenant superseding all prior oral or written negotiations, representations, understandings, or agreements. No modification hereof shall be binding unless executed in writing by both Parties.

5.3 Force Majeure

Neither Party shall be held liable for any failure or delay in performance under this Agreement (excluding financial obligations) if such failure arises from acts of God, war, terrorism, civil unrest, natural disasters, epidemics, pandemics, government utility shut-offs, or other extraordinary events beyond the reasonable control of the affected Party.

5.4 Governing Law and Venue

This Agreement shall be construed, interpreted, and governed by the laws of the State/Jurisdiction of [Jurisdiction], without regard to its conflict of laws principles. Any legal action, proceeding, or arbitration arising out of this Agreement shall be brought exclusively in the state or federal courts located within [County, State], and the Parties hereby consent to the personal jurisdiction thereof.

5.5 Dispute Resolution

Any controversy or claim arising out of or relating to this Agreement, or the breach thereof, shall be settled by binding arbitration administered by [Arbitration Body, e.g., the American Arbitration Association] in accordance with its Residential Arbitration Rules.
