STEP-BY-STEP EXECUTION & FILING GUIDE

  1. Drafting: Replace all bracketed text [ ] with actual data. Ensure the VIN and vehicle description match the Title documents exactly.
  2. Lien Filing: Immediately upon execution, visit your local Department of Motor Vehicles (DMV) or equivalent agency to record the Lender’s lien on the vehicle title. This is critical to ensure the "Secured" status of this note.
  3. Digital Execution: If using DocuSign or Adobe Sign, ensure the "Audit Trail" feature is enabled to capture IP addresses and timestamps for all signatories.
  4. Notarization: While not always mandatory for a Note, having the signatures notarized is highly recommended to prevent future claims of forgery or dispute over identity.
  5. Record Retention: The Lender must retain the original "wet-ink" signed note in a fireproof, secure location. A digital copy should be transmitted to the Borrower immediately upon signing.
  6. UCC Filing: In commercial contexts or high-value transactions, file a UCC-1 Financing Statement with the Secretary of State to provide public notice of the security interest.
