6. STEP-BY-STEP EXECUTION & FILING GUIDE
- Preparation: Open this document in Microsoft Word or Google Docs. Use the "Find and Replace" function to locate all bracketed fields (e.g.,
[Principal Full Legal Name]) and input the correct legal data. - Review: Ensure all optional powers in Section 3.1 are consistent with the Principal's intent. If specific powers are not desired, they must be struck through and initialed.
- Signatory Authority: The Principal must be of sound mind. If there is a question of capacity, obtain a physician's letter prior to signing.
- Execution (Notarization):
- The Principal must sign the document in the physical presence of a licensed Notary Public.
- While Oregon law may allow for witnesses, a Notary is the gold standard for financial institutions and the County Clerk's office for real estate deeds.
- Digital Signature: If using DocuSign or Adobe Sign, ensure the platform provides a "Digital Audit Trail." Note that for recording real estate deeds in Oregon, many counties still require "wet ink" original notarized signatures.
- Distribution & Retention:
- Original: The Agent should keep the original document in a secure, fireproof location.
- Copies: Provide copies to the Principal’s bank, investment advisor, and any title companies involved in pending transactions.
- Recording: If the Agent intends to sell real property, the original POA must be recorded with the County Clerk in the Oregon county where the property is located.
