FREE MENTAL HEALTH INTAKE FORM AND SERVICES AGREEMENT

This Mental Health Intake and Services Agreement (the "Agreement") is entered into as of this ____ day of ________, 20 (the "Effective Date"), by and between [Provider Name/Entity Name], with a principal place of business located at [Provider Address] (the "Provider"), and [Client Name], residing at [Client Address] (the "Client").

1. RECITALS

WHEREAS, the Provider is engaged in the provision of mental health services and desires to offer intake assessment services to the Client; WHEREAS, the Client desires to obtain such services subject to the terms and conditions set forth herein; WHEREAS, both parties acknowledge that this Agreement is governed by the laws of [Jurisdiction] and constitutes a binding legal commitment regarding the intake process and subsequent care protocols.

2. OPERATIONAL DEFINITIONS

2.1. "Intake Services" refers to the initial clinical assessment, data collection, and diagnostic screening performed by the Provider. 2.2. "Protected Health Information (PHI)" shall have the meaning ascribed to it under the Health Insurance Portability and Accountability Act of 1996 (HIPAA). 2.3. "Clinical Records" refers to all notes, assessments, and historical data gathered during the Term. 2.4. "Dispute" means any controversy, claim, or disagreement arising out of or relating to this Agreement or the services provided hereunder. 2.5. "Business Day" means any day, excluding Saturday, Sunday, or federal holidays, upon which commercial banks are open for business in [Jurisdiction].

3. SUBSTANTIVE TERMS AND OBLIGATIONS

3.1. Scope of Intake: The Provider shall perform a comprehensive mental health intake assessment to determine the appropriateness of ongoing clinical care. 3.2. Client Obligations: The Client warrants that all information provided during the intake process is truthful, accurate, and complete to the best of the Client's knowledge. 3.3. Payment Terms: While the initial intake form is provided as a free administrative tool, any subsequent clinical time shall be billed at a rate of [Dollar Amount] per hour, payable within [Number] days of invoice receipt. 3.4. Confidentiality: The Provider shall maintain the confidentiality of all PHI in strict accordance with applicable state and federal regulations. 3.5. 4. DEFAULT, TERMINATION, AND REMEDIES

4.1. Material Breach: A material breach occurs if either party fails to perform any obligation herein, including but not limited to, failure to maintain confidentiality or failure to remit payment. 4.2. Notice and Cure: The non-breaching party shall provide written notice of the breach. The breaching party shall have thirty (30) Business Days from the receipt of such notice to cure said breach. 4.3. 5.1. Severability: If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. 5.2. Entire Agreement: This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements or communications. 5.3. Force Majeure: Neither party shall be liable for failure to perform due to causes beyond their reasonable control, including acts of God, war, or governmental regulation. 5.4.
