WHEREAS, the Tenant has breached the terms of the Lease Agreement and/or the applicable statutory framework governing tenancies within the jurisdiction of [Province/Jurisdiction, e.g., Ontario], specifically under the statutory authority of [Applicable Legislation, e.g., Residential Tenancies Act, 2006]; and

WHEREAS, the Landlord is entitled under law and equity to terminate the tenancy, demand possession of the Premises, and pursue all available remedies for default;

NOW, THEREFORE, in consideration of the mutual covenants contained herein and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the Parties agree and this Notice mandates as follows:

SECTION 1: OPERATIONAL DEFINITIONS

For the purposes of this Agreement and Notice, the following terms shall have the precise meanings set forth below, and grammatical variations shall be construed accordingly:

1.1. "Applicable Law" means all applicable statutes, acts, codes, regulations, ordinances, and judicial precedents of [Jurisdiction], including specifically [Applicable Tenancy Legislation].

1.2. "Base Rent" means the fixed monthly financial consideration of [Monthly Rent Amount] payable by the Tenant to the Landlord pursuant to the Lease Agreement.

1.3. "Default" means any breach, violation, or non-performance of any covenant, term, provision, or condition of the Lease Agreement or Applicable Law by the Tenant, including but not limited to non-payment of rent, unlawful interference, or property damage.

1.4. "Effective Date of Termination" means the exact date by which the Tenant must completely vacate, yield up, and surrender possession of the Premises to the Landlord, established herein as [Termination Date].

1.5. "Landlord" means the legal owner of the Premises, or any authorized property manager, agent, or legal representative acting with express authority on behalf of the owner.

1.6. "Notice Period" means the statutory or contractual duration mandated for the curing of a Default or the surrender of the Premises, defined herein as precisely thirty (30) business days from the date of formal service.

1.7. "Premises" means the specific real property, dwelling unit, or commercial space legally described as [Full Legal Description or Municipal Address], including all appurtenances, parking spaces, and storage lockers allocated thereto.

1.8. "Tenant" means the individual(s) or corporate entity executing the Lease Agreement as lessee, including all occupants, subtenants, and licensees claiming possession under or through the lessee.

SECTION 2: SUBSTANTIVE TERMS & OBLIGATIONS

2.1. Notice of Material Breach. The Landlord hereby formally notifies the Tenant that a material Default of the Lease Agreement has occurred. The specific nature of the Default is categorized as follows: [ ] Non-payment of Base Rent in the total arrears amount of [Dollar Amount]. [ ] Persistent late payment of rent. [ ] Unlawful subletting or assignment without Landlord consent. [ ] Substantial interference with the reasonable enjoyment of the Landlord or other tenants. [ ] Willful or negligent damage to the Premises. [ ] Other: [Specify Detailed Grounds for Eviction].

2.2. Demand for Possession. The Tenant is hereby strictly commanded to vacate and surrender vacant possession of the Premises to the Landlord no later than 11:59 PM local time on the Effective Date of Termination, being [Termination Date]. Surrender shall include the delivery of all keys, access cards, fobs, and security devices to the Landlord or its designated agent.

2.3. Condition of Premises upon Surrender. Upon vacating, the Tenant covenants and warrants that the Premises shall be returned to the Landlord in a clean, undamaged condition, normal wear and tear excepted. The Tenant shall remove all personal property, debris, and refuse. Any property remaining after the Effective Date of Termination shall be deemed conclusively abandoned and disposed of by the Landlord at the Tenant’s sole expense pursuant to Applicable Law.

2.4. Financial Obligations and Arrears. The issuance of this Notice does not waive, release, or discharge the Tenant from any accrued financial liabilities. The Tenant remains strictly obligated to pay all outstanding Base Rent, utility charges, late fees, and indemnification for damages up to and including the date actual physical possession is returned to the Landlord.

2.5. Representations and Warranties of the Tenant. The Tenant warrants that they possess the legal capacity to enter into this arrangement, that no unauthorized occupants reside within the Premises, and that no encumbrances, liens, or third-party claims have been attached to the leasehold interest.

SECTION 3: DEFAULT, TERMINATION, AND REMEDIES

3.1. Classification of Default. Failure to cure a remediable Default (where permitted by Applicable Law) within the designated cure period, or failure to vacate the Premises by the Effective Date of Termination, shall constitute an immediate, incurable Event of Default under this Notice and the underlying Lease Agreement.

3.2. Cure Period and Statutory Rights. Where Applicable Law provides a statutory right to cure the Default, the Tenant is hereby granted a strict cure period of thirty (30) business days from the date of service of this Notice to pay all outstanding arrears in the amount of [Dollar Amount] or otherwise rectify the specified non-financial breach to the absolute satisfaction of the Landlord.

3.3. Legal Recourse and Administrative Filings. If the Tenant fails to surrender possession of the Premises by the Effective Date of Termination or fails to cure the Default within the mandated timeframe, the Landlord reserves the absolute right to immediately: a. Initiate formal legal proceedings before the appropriate judicial, administrative, or tribunal body (e.g., the Landlord and Tenant Board of [Jurisdiction]) for an expedited Order of Eviction and Writ of Possession. b. Pursue all legal remedies for collection of rent arrears, double damages for overholding where permitted by statute, and legal costs. c. Engage licensed bailiffs or court-appointed enforcement officers to execute physical eviction as authorized by judicial writ.

3.4. Indemnification for Enforcement Costs. The Tenant shall indemnify, defend, and hold harmless the Landlord from and against any and all legal fees, court costs, administrative filing fees, bailiff expenses, and consequential damages incurred by the Landlord as a direct or indirect result of the Tenant's Default and failure to vacate.

SECTION 4: BOILERPLATE LEGAL PROVISIONS

4.1. Severability. If any provision of this Agreement or Notice is held to be invalid, illegal, or unenforceable by a court or administrative tribunal of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable. The remaining provisions shall remain in full force and effect and shall not be affected thereby.

4.2. Entire Agreement. This Notice, together with the underlying Lease Agreement, constitutes the entire understanding between the Parties concerning the termination of the tenancy and supersedes all prior oral or written negotiations, representations, or agreements. No modification of this Notice shall be valid unless executed in writing by both Parties.

4.3. Force Majeure. Neither Party shall be held liable for any failure or delay in the performance of its non-financial obligations under this Notice if such failure arises from acts of God, war, terrorism, civil unrest, natural disasters, or governmental restrictions beyond the reasonable control of the affected Party.
