NOW, THEREFORE, Landlord hereby provides formal legal notice to Tenant to vacate and surrender possession of the Premises in accordance with the terms set forth herein.

SECTION 2: OPERATIONAL DEFINITIONS

For purposes of this Notice, the following terms shall have the meanings ascribed below, and such definitions shall apply equally to the singular and plural forms of the terms defined:

  1. "Breach" means any failure by Tenant to perform, observe, or comply with any covenant, condition, restriction, obligation, or provision of the Lease Agreement or Maryland statutory law.
  2. "Business Day" means any calendar day other than a Saturday, Sunday, or a legal holiday recognized by the State of Maryland or the federal government of the United States.
  3. "Cure Period" means the specific, mandatory timeframe granted to Tenant under Maryland law and this Notice to rectify a remediable Breach prior to the initiation of formal judicial eviction proceedings.
  4. "Landlord" means the fee simple owner, lessor, sublessor, or authorized management agent, including [Landlord/Property Manager Name], having the legal authority to enforce the terms of the Lease Agreement and demand possession of the Premises.
  5. "Lease Agreement" means the binding rental contract, whether written or oral, executed or implied, governing the occupancy of the Premises by Tenant.
  6. "Notice" means this formal legal instrument executed by Landlord to notify Tenant of Lease termination and demand the surrender of the Premises.
  7. "Premises" means the specific real property and any appurtenances thereto located at [Rental Property Address, Unit Number, City, State, ZIP], including all parking spaces, storage units, and common elements assigned exclusively thereto.
  8. "Tenant" means any and all individual lessees, occupants, subtenants, and unauthorized claimants in possession of the Premises under or through the Lease Agreement, specifically including [Tenant Name(s)].

SECTION 3: SUBSTANTIVE TERMS & OBLIGATIONS

  1. Demand for Possession. Landlord hereby demands that Tenant, and each of them, peaceably vacate and surrender the Premises, together with all keys, access cards, and personal property not belonging to Landlord, no later than [Exact Time, e.g., 11:59 PM] on [Vacate Date] (the "Surrender Date").
  2. Statement of Grounds. This Notice is issued and served based upon the following specific default(s):
    • Non-Payment of Rent: Tenant has failed to pay rent in the total outstanding amount of [Dollar Amount] for the rental period(s) spanning [Date Range], pursuant to Maryland Code, Real Property Article § 8-401.
    • Breach of Lease Conditions: Tenant has violated Section [Section Number] of the Lease Agreement by engaging in the following prohibited conduct: [Detailed Description of Lease Violation], pursuant to Maryland Code, Real Property Article § 8-402.1.
    • Holdover Tenancies: The term of the Lease Agreement has expired or been properly terminated, and Tenant remains in possession without the consent of Landlord, pursuant to Maryland Code, Real Property Article § 8-402.
  3. Tenant Performance Metrics & Obligations. Pending the Surrender Date, Tenant remains strictly obligated to:
    • (a) Comply with all existing provisions, rules, and covenants of the Lease Agreement;
    • (b) Maintain the Premises in a clean, safe, and undamaged condition, ordinary wear and tear excepted; and
    • (c) Permit Landlord or Landlord’s designated agents reasonable access to the Premises for inspection, appraisal, or showing to prospective purchasers or tenants, upon providing reasonable notice as required by Maryland law.
  4. Representations and Warranties. Landlord represents that it is the lawful owner or authorized agent of the owner of the Premises, possessing the requisite legal standing under Maryland jurisprudence to issue this Notice and institute summary ejectment proceedings upon expiration of the cure or notice periods.

SECTION 4: DEFAULT, TERMINATION, AND REMEDIES

  1. Classification of Default. Tenant’s failure to cure the defaults identified in Section 3 within the designated timeframe constitutes an immediate and material event of default, resulting in the absolute forfeiture of the tenancy.
  2. Cure Periods and Statutory Compliance:
    • (a) For Non-Payment of Rent: Pursuant to Maryland law, Tenant is provided formal notice of the outstanding rent balance. Tenant may cure this default by paying the full balance of [Dollar Amount] plus any applicable late fees authorized by the Lease Agreement to Landlord prior to the expiration of the statutory notice period.
    • (b) For Breach of Lease: Tenant is hereby provided a Cure Period of thirty (30) business days from the date of receipt of this Notice to completely remedy the specified Lease violation. If the Breach is remediable through reasonable efforts, and Tenant substantially cures said Breach within the 30-day Cure Period, the threatened termination shall be rescinded for this specific incident only.
    • (c) For Holdover Tenancies: No cure period is available where the lease term has expired and Landlord has elected not to renew the tenancy.
  3. Judicial Recourse and Summary Ejectment. If Tenant fails to quit and surrender the Premises or cure the underlying default within the timeframes mandated by this Notice and Maryland law, Landlord shall immediately pursue all available legal and equitable remedies. This includes, without limitation, filing an action for Failure to Pay Rent, Breach of Lease, or Tenant Holding Over in the District Court of Maryland for [County Name] County.
  4. Recovery of Damages and Costs. In the event legal action is initiated, Landlord reserves the right to seek and recover from Tenant:
    • (a) All unpaid past-due rent and holdover damages calculated at the statutory or contractual rate;
    • (b) Reasonable attorney’s fees and court costs, to the extent permitted by the Lease Agreement and Maryland statutory provisions; and
    • (c) Any and all actual damages sustained by Landlord as a result of Tenant’s unlawful holdover or breach.

SECTION 5: BOILERPLATE LEGAL PROVISIONS

  1. Severability. If any provision of this Notice is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable. The remaining provisions of this Notice shall remain in full force and effect and shall not be affected thereby.
  2. Entire Agreement. This Notice constitutes the entire expression of Landlord's demand for possession and supersedes any prior oral or written communications, negotiations, or understandings between the parties regarding the termination of the Lease Agreement, save for the underlying Lease Agreement itself which governs ongoing tenancy obligations until formal eviction.
  3. Force Majeure. Neither party shall be held liable for any failure or delay in performing obligations under this Notice if such failure arises from acts of God, war, terrorism, civil unrest, public health emergencies, governmental restrictions, or other catastrophic events beyond the reasonable control of the affected party, excluding financial inability to pay rent.
  4. Governing Law. This Notice, and all legal rights, remedies, obligations, and disputes arising herefrom or related thereto, shall be governed by, construed, and enforced in accordance with the laws of the State of Maryland, without regard to its conflict of laws principles.
  5. Dispute Resolution and Venue. Any legal action, proceeding, or alternative dispute resolution arising out of or relating to this Notice or the termination of the tenancy shall be brought exclusively in the District Court of Maryland sitting in [County Name] County, or the Circuit Court for [County Name] County, and the parties hereby irrevocably submit to the personal jurisdiction of said courts.
