WHEREAS, Landlord and Tenant entered into a certain written or oral Residential Lease Agreement dated [Lease Agreement Date] (hereinafter, the "Lease Agreement") concerning the real property located in [County Name] County, Kansas; and

WHEREAS, Tenant has breached the terms and conditions of the Lease Agreement and/or the statutory obligations imposed by the Kansas Residential Landlord and Tenant Act, K.S.A. 58-2550 et seq., by failing to perform or observe covenants as detailed herein;

NOW, THEREFORE, Landlord hereby provides formal legal notice demanding strict compliance, cure of default, or complete vacation and surrender of the premises within the strict statutory timeframes set forth herein.

SECTION 1: OPERATIONAL DEFINITIONS

For purposes of this Notice, the following terms shall have the meanings ascribed below, and such definitions shall apply equally to the singular and plural forms of the terms defined:

1.1 "Actual Notice" means receipt of written notice by the Tenant, whether delivered personally, via certified mail, or through statutory posting and mailing pursuant to Kansas law.

1.2 "Business Day" means any calendar day other than a Saturday, Sunday, or a legal holiday recognized by the State of Kansas or the federal government.

1.3 "Cure Period" means the exact statutory or contractual window of time granted to the Tenant to rectify a remediable default prior to the initiation of formal forcible detainer or eviction proceedings.

1.4 "Default" means the failure of the Tenant to perform, keep, or observe any material covenant, condition, obligation, or payment term of the Lease Agreement or applicable Kansas law.

1.5 "Demand for Possession" means the unequivocal legal requirement that the Tenant vacate, surrender, and return complete, unencumbered physical possession of the Premises to the Landlord.

1.6 "Lease Agreement" means the underlying rental agreement, whether written or oral, governing the occupancy of the Premises by the Tenant.

1.7 "Premises" means the specific real property and any appurtenances located at [Rental Property Address, Unit Number, City, State, ZIP].

1.8 "Statutory Notice Period" means the mandatory minimum notification timeline prescribed by the Kansas Residential Landlord and Tenant Act (K.S.A. 58-2501 et seq.).

SECTION 2: SUBSTANTIVE TERMS & OBLIGATIONS

2.1 Identification of Breach. Tenant is currently in material breach of the Lease Agreement and/or Kansas statutory law due to the following specific occurrence(s):

  • Non-Payment of Rent: Failure to pay past-due rent in the total amount of [Dollar Amount], representing rent due for the period(s) of [Date Range].
  • Non-Compliance with Lease Covenants: Violation of Section [Section Number] of the Lease Agreement regarding [Description of Lease Violation, e.g., unauthorized pets, subletting, noise, property damage].
  • Material Non-Compliance Affecting Health and Safety: Action or omission by Tenant materially affecting health and safety in violation of K.S.A. 58-2555, specifically: [Detailed Description of Health/Safety Violation].

2.2 Tenant Performance Metrics & Immediate Obligations. Tenant shall, within the applicable Cure Period defined in Section 3 of this Notice, either:

  • (a) Remit full payment of all outstanding financial obligations via certified funds to the Landlord at the designated address; or
  • (b) Completely cure any non-monetary lease violation to the reasonable satisfaction of the Landlord; or
  • (c) Vacate and surrender the Premises, removing all personal property and occupants, and returning all keys, access cards, and garage door openers to the Landlord.

2.3 Representations and Warranties of Landlord. Landlord represents and warrants that Landlord is the lawful owner or authorized agent of the owner of the Premises, possessing the legal right to issue this Notice and demand possession pursuant to the laws of the State of Kansas.

2.4 Continuation of Obligation. Receipt of partial payments by Landlord subsequent to the issuance of this Notice shall not constitute a waiver of this Notice or a reinstatement of the Lease Agreement, unless expressly agreed to in a separate, signed writing by the Landlord pursuant to K.S.A. 58-2564.

SECTION 3: DEFAULT, TERMINATION, AND REMEDIES

3.1 Classification of Default & Cure Periods. Defaults are classified pursuant to Kansas law, and the applicable cure or termination windows are designated as follows:

  • (a) For Non-Payment of Rent: Pursuant to K.S.A. 58-2564(b), Tenant is hereby granted a period of three (3) consecutive Business Days from the date of Actual Notice to pay the delinquent balance of [Dollar Amount].
  • (b) For Non-Compliance (Remediable): Pursuant to K.S.A. 58-2564(a), Tenant is hereby granted a period of fourteen (14) calendar days from receipt of this Notice to remedy the non-compliance. If not remedied, the Lease Agreement shall terminate on [Termination Date].
  • (c) For Material Non-Compliance Affecting Health and Safety: If the breach is remediable by repairs, the replacement of damaged items, or cleaning, and the Tenant fails to comply as expeditiously as conditions require—not to exceed fourteen (14) calendar days after receipt of written notice—Landlord may enter the Premises and cause the work to be done, billing the actual and reasonable cost to the Tenant as rent. If the non-compliance is deemed irremediable or materially affects health and safety under K.S.A. 58-2564(a), the tenancy terminates immediately upon notice.

3.2 Legal Recourse and Judicial Proceedings. If the Tenant fails to cure the specified Default(s) within the mandatory Cure Period, or fails to surrender possession of the Premises by the designated termination date, the Landlord shall immediately pursue all available legal remedies without further notice, including the filing of a Forcible Detainer (Eviction) action in the District Court of [County Name] County, Kansas, pursuant to K.S.A. 61-3801 et seq.

3.3 Recovery of Damages and Costs. In the event legal action is instituted to recover possession of the Premises, collect unpaid rent, or enforce damages, the Landlord shall be entitled to recover, to the maximum extent permitted by Kansas law and the Lease Agreement:

  • (a) All past-due and accelerated rent;
  • (b) Court costs and filing fees;
  • (c) Reasonable attorney's fees as authorized by the Lease Agreement and Kansas statute; and
  • (d) Statutory holdover damages for each day Tenant remains in unlawful possession of the Premises.

SECTION 4: BOILERPLATE LEGAL PROVISIONS

4.1 Severability. If any provision, clause, or section of this Notice is rendered invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the validity or enforceability of any remaining provisions, which shall continue in full force and effect.

4.2 Entire Agreement. This Notice constitutes the entire expression of the Landlord's demand regarding the specified defaults and supersedes any prior oral or written communications, negotiations, or understandings, save for the underlying Lease Agreement.

4.3 Force Majeure. Neither party shall be held liable for any failure of performance resulting from acts of God, war, civil unrest, natural disasters, or governmental restrictions, provided that financial obligations (payment of rent) shall under no circumstances be excused by a Force Majeure event.

4.4 Governing Law and Venue. This Notice, the tenancy hereby terminated, and any ensuing legal proceedings shall be governed, construed, and enforced in accordance with the substantive laws of the State of Kansas, specifically the Kansas Residential Landlord and Tenant Act (K.S.A. 58-2501 et seq.). Exclusive venue for any judicial proceeding shall lie in the District Court of [County Name] County, Kansas.

4.5 Dispute Resolution. Any legal action arising out of or relating to this Notice or the underlying Lease Agreement shall be adjudicated exclusively through the judicial court system of the State of Kansas.
