WHEREAS, Landlord is the lawful owner and/or authorized managing agent of the real property located at [Premises Street Address, Unit Number, City, State, Zip Code] (the "Premises"); and

WHEREAS, Landlord and Tenant entered into a certain residential/commercial lease agreement dated [Lease Agreement Date] (the "Lease"); and

WHEREAS, Landlord now seeks to exercise its legal rights to demand the immediate cure of said defaults or, alternatively, the absolute surrender and delivery of vacant possession of the Premises to Landlord in accordance with the laws of the jurisdiction of [Jurisdiction].

NOW, THEREFORE, Landlord hereby provides formal legal notice to Tenant as set forth below.

2. Operational Definitions

For purposes of this Notice, the following terms shall have the meanings ascribed to them below, and such definitions shall be equally applicable to both the singular and plural forms of the terms defined:

  1. "Agreement" or "Lease" means that certain rental agreement, lease contract, or tenancy-at-will arrangement executed by and between Landlord and Tenant on [Lease Agreement Date], governing the occupancy of the Premises.
  2. "Business Day" means any calendar day other than a Saturday, Sunday, or any legal holiday recognized by the federal government or the State of [State].
  3. "Cure Period" means the exact statutory or contractual window of [Number of Days, e.g., 30] business days commencing on the date of service of this Notice during which Tenant is afforded the opportunity to rectify the specified Default.
  4. "Default" means any breach, violation, non-payment, or failure of performance by Tenant regarding any covenant, term, condition, or statutory obligation under the Lease or applicable law.
  5. "Landlord" means the fee simple owner, master lessor, or authorized legal representative/property management entity possessing the legal authority to enforce the terms of the Lease and demand possession of the Premises.
  6. "Notice" means this formal legal instrument, inclusive of all recitals, definitions, operative terms, default provisions, and execution blocks.
  7. "Premises" means the specific real property, including any appurtenances, parking spaces, storage units, and improvements, located at [Premises Street Address, Unit Number, City, State, Zip Code].
  8. "Tenant" means the individual(s) or corporate entity(ies) executing the Lease as lessee(s) and occupying the Premises.

3. Substantive Terms & Obligations

  1. Demand for Cure or Surrender. Tenant is hereby formally notified that Tenant is in material default of the Lease. Tenant is required to either: (a) fully cure the Default specified in Section 4 of this Notice within the designated Cure Period; or (b) completely vacate and surrender peaceful and vacant possession of the Premises to Landlord no later than 11:59 PM local time on [Surrender Date].
  2. Specification of Breach. Tenant has breached the Lease and/or statutory duties through the following acts or omissions:
    • Non-Payment of Rent: Failure to pay outstanding rent in the total principal amount of [Dollar Amount] for the rental period(s) spanning [Date Range].
    • Lease Covenants Violation: Violation of Section [Lease Section Number] of the Lease regarding [Description of Violation, e.g., unauthorized pets, subletting, noise, nuisance].
    • Holding Over: Remaining in possession of the Premises after the expiration or lawful termination of the Lease term.
  3. Continuation of Obligations. Tenant acknowledges and agrees that the issuance of this Notice does not waive, release, or impair Landlord's right to collect past-due rent, late fees, utility charges, or any other monetary obligations accrued or accruing under the Lease, regardless of whether Tenant vacates the Premises.
  4. Inspection and Access Rights. Upon expiration of the Cure Period without full cure by Tenant, Landlord, its agents, attorneys, and law enforcement officers shall retain the absolute right to enter and inspect the Premises to verify vacancy and secure the property pursuant to applicable statutory protocols.

4. Default, Termination, and Remedies

  1. Classification of Default. The failure of Tenant to remit payment for all outstanding sums or to cease and desist the prohibited conduct outlined in Section 3 within the Cure Period shall constitute an incurable event of default under this Notice and the Lease.
  2. Notice and Cure Period. Pursuant to the terms of the Lease and the laws of [Jurisdiction], Tenant is hereby granted a mandatory cure period of exactly thirty (30) business days from the date of proper service of this Notice to rectify the specified monetary or non-monetary default. Time is of the essence with respect to this Cure Period.
  3. Legal Recourse and Judicial Proceedings. If Tenant fails to cure the Default or surrender the Premises within the designated Cure Period, Landlord shall immediately pursue all available legal and equitable remedies without further notice, including but not limited to:
    • Filing an unlawful detainer or forcible entry and detainer action in the appropriate court of [Jurisdiction] to obtain a writ of restitution and immediate judicial eviction.
    • Seeking a monetary judgment against Tenant for unpaid rent, holdover damages, court costs, filing fees, and reasonable attorney's fees as authorized by the Lease and applicable law.
    • Engaging collection agencies and reporting the default to major consumer credit reporting bureaus.
  4. Cumulative Remedies. All remedies set forth herein are cumulative and concurrent, and the exercise of one remedy by Landlord shall not constitute an election or waiver of any other available legal or equitable remedy.

5. Boilerplate Legal Provisions

  1. Severability. If any provision, clause, or section of this Notice is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the remaining provisions hereof, which shall continue in full force and effect as if the invalid provision had never been included.
  2. Entire Agreement. This Notice constitutes the entire expression of Landlord's demand and supersedes all prior oral or written negotiations, representations, understandings, or communications between Landlord and Tenant regarding the subject matter hereof.
  3. Force Majeure. Neither party shall be held liable for any failure or delay in performance under this Notice if such failure arises from acts of God, war, terrorism, civil unrest, natural disasters, or other catastrophic events beyond the reasonable control of the affected party, expressly excluding Tenant's financial inability to pay rent.
  4. Governing Law. This Notice, and all disputes arising out of or related thereto, shall be governed by, construed, and enforced in accordance with the internal laws of the State of [State], without regard to its conflict of laws principles.
  5. Dispute Resolution and Venue. Any legal action, proceeding, or arbitration arising out of this Notice or the tenancy shall be brought exclusively in the state or federal courts located within [County], State of [State], and Tenant hereby irrevocably consents to the personal jurisdiction and venue of such courts.
