WHEREAS, Landlord possesses the legal right under the laws of the State of [State] and the jurisdiction of [County/City] to terminate the Lease and demand possession of the Premises;

NOW, THEREFORE, in consideration of the mutual covenants, terms, and conditions set forth herein, and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the Parties agree as follows:

2. OPERATIONAL DEFINITIONS

For the purposes of this Agreement, the following terms shall have the meanings ascribed below, and such definitions shall apply equally to the singular and plural forms of the terms defined:

  1. "Agreement" means this comprehensive eviction notice and binding legal form, including all attached exhibits and incorporated recitals.

  5. "Default" means an uncured Breach that persists beyond the expiration of the applicable Cure Period.
  6. "Effective Date" means the date first written above, upon which this legal instrument becomes fully binding and enforceable upon the Parties.

  8. "Lease" means the underlying written or oral rental agreement executed between Landlord and Tenant on [Lease Date] for the occupancy of the Premises.
  9. "Notice Period" means the mandatory statutory notification window required by the laws of [Jurisdiction] prior to the legal repossession of the Premises.
  10. "Premises" means the real property, including any appurtenances, structures, and designated parking areas located at [Property Address].
  11. "Rent" means the monthly financial consideration, including base rent, late fees, utilities, and other assessments, due from Tenant to Landlord pursuant to the Lease.
  12. "Tenant" means the individual(s) or legal entity(ies) executing the Lease and occupying the Premises.

3. SUBSTANTIVE TERMS & OBLIGATIONS

  1. Notice of Termination. Landlord hereby formally notifies Tenant that the Lease is terminated effective as of [Termination Date] (hereinafter the "Termination Date"). Tenant is strictly required to vacate and surrender complete, unencumbered physical possession of the Premises to Landlord no later than 11:59 PM on the Termination Date.
  2. Grounds for Eviction. This Agreement is issued and served based upon the following material default(s) under the Lease:
    • Non-payment of Rent in the total amount of [Dollar Amount] for the rental period(s) of [Rental Periods].
    • Material non-compliance with lease covenants regarding [Specific Violation, e.g., unauthorized occupants, pets, property damage].
    • Holding over after the expiration of the fixed-term Lease without Landlord's written consent.
  3. Financial Obligations and Outstanding Balance. Tenant remains strictly liable for all accrued and unpaid Rent, late charges, utilities, and property damage assessments totaling [Total Dollar Amount Due], payable immediately upon receipt of this notice via certified funds or electronic transfer to Landlord's designated account.
  4. Duty to Inspect and Surrender. Tenant covenants and agrees that upon vacating, the Premises shall be returned to Landlord in the exact condition as received on the commencement date of the Lease, normal wear and tear excepted. Tenant shall complete a joint move-out inspection with Landlord or Landlord's agent upon prior appointment.
  5. Representations and Warranties of Tenant. Tenant represents and warrants that:
    • (a) Tenant has the legal capacity and authority to execute this Agreement and surrender the Premises;
    • (b) No liens, encumbrances, or subleases have been created by Tenant that would survive the termination of the Lease; and
    • (c) All personal property remaining on the Premises after the Termination Date shall be conclusively deemed abandoned pursuant to Section 4.3 herein.

4. DEFAULT, TERMINATION, AND REMEDIES

  1. Classification of Breach and Cure Periods.
    • (a) Monetary Default: For failure to pay Rent, Tenant is hereby granted a strict Cure Period of [e.g., 3 to 14] Business Days from the date of service of this Agreement to pay the total outstanding balance in full.
    • (b) Non-Monetary Breach: For covenant violations capable of cure, Tenant is granted a Cure Period of [e.g., 10 to 30] Business Days to fully remedy the violation.
    • (c) Incurable Breach: For illegal acts, severe property damage, or repeat violations where permitted by applicable law, no cure period shall apply, and termination is immediate upon service.
  2. Failure to Cure and Judicial Proceedings. If Tenant fails to completely cure the specified Default within the applicable Cure Period or fails to vacate the Premises by the Termination Date, Landlord shall immediately possess the absolute legal right to file a Forcible Entry and Detainer action, unlawful detainer lawsuit, or summary ejectment proceeding in the court of competent jurisdiction for [Jurisdiction].
  3. Landlord's Remedies for Holdover and Non-Compliance. In the event of judicial proceedings, Landlord shall be entitled to seek and recover:
    • (a) A judgment for immediate writ of possession of the Premises;
    • (b) Statutory double or treble damages for unlawful holdover, where authorized by local statute;
    • (c) All accrued back rent, future rent through the end of the original lease term (subject to mitigation), and associated fees; and
    • (d) Reasonable attorney's fees, court costs, process server fees, and administrative expenses incurred in the enforcement of Landlord's rights.
  4. Handling of Abandoned Property. Any personal property remaining on the Premises after the expiration of the Termination Date and any applicable statutory grace period shall be deemed conclusively abandoned by Tenant. Landlord may, at its sole discretion, remove, store, sell, or dispose of such property at Tenant's sole expense, without incurring any liability to Tenant whatsoever.

5. BOILERPLATE LEGAL PROVISIONS

  1. Severability. If any provision, clause, or section of this Agreement is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the remaining provisions hereof, which shall continue in full force and effect as if the invalid provision had never been included.
  2. Entire Agreement. This Agreement, together with the underlying Lease, constitutes the entire understanding between Landlord and Tenant regarding the termination of tenancy and eviction. No oral representations, understandings, or prior agreements shall alter, amend, or modify the terms hereof unless executed in writing by both Parties.
  3. Force Majeure. Neither Party shall be held liable for any failure or delay in performing obligations under this Agreement if such failure arises from acts of God, war, terrorism, civil unrest, natural disasters, utility failures, pandemics, or governmental restrictions beyond the reasonable control of the affected Party, excluding, however, Tenant’s financial inability to pay rent.
  4. Governing Law and Venue. This Agreement shall be governed by, construed, and enforced in accordance with the substantive laws of the State of [State], without regard to its conflict of laws principles. Any legal action, proceeding, or dispute arising out of or relating to this Agreement shall be brought exclusively in the municipal, county, or state courts located within [County] County, [State]`.
  5. Dispute Resolution and Arbitration. Any controversy, claim, or dispute arising out of or relating to this Agreement, excepting summary eviction and unlawful detainer actions brought by Landlord to recover possession of the Premises, shall be settled by binding arbitration administered by [Arbitration Association, e.g., AAA] in accordance with its commercial arbitration rules. Judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
  6. Waiver. The failure of Landlord to insist upon strict performance of any term, covenant, or condition of this Agreement shall not constitute a waiver of Landlord's right to demand strict compliance thereafter, nor shall it be construed as a waiver of any subsequent Default or Breach.
  7. Notice Delivery. All formal notices required under this Agreement shall be deemed legally served if delivered personally, sent via certified mail (return receipt requested) to the Premises or Tenant's last known forwarding address, or posted conspicuously on the primary entrance door of the Premises in accordance with state statutory service requirements.
