EVICTION NOTICE FORM FOR NON-PAYMENT OF RENT

1. Document Preamble & Recitals

THIS BINDING LEGAL NOTICE AND AGREEMENT (hereinafter the "Notice") is entered into and made effective as of [Effective Date] (the "Effective Date"), by and between [Landlord/Property Manager Entity Name], having its principal place of business at [Landlord Address] (hereinafter referred to as the "Landlord"), and [Tenant Name(s)], currently residing at [Rental Property Address] (hereinafter referred to as the "Tenant").

WHEREAS, Landlord and Tenant entered into a certain written Lease Agreement dated [Lease Date] (the "Master Lease"), whereby Landlord leased to Tenant and Tenant leased from Landlord the real property located at [Rental Property Address], including all appurtenances thereto (the "Premises"); and

WHEREAS, pursuant to the Master Lease, Tenant covenanted and agreed to pay monthly rent in the amount of [Monthly Rent Amount] on or before the [Day of Month] day of each calendar month; and

WHEREAS, Tenant has failed to tender the required rent payment for the rental period(s) of [Unpaid Rental Periods], resulting in an outstanding principal monetary default in the aggregate amount of [Total Unpaid Rent Amount], exclusive of late fees, administrative penalties, and accumulated statutory interest; and

WHEREAS, Landlord now issues this formal legal demand and statutory notice to cure or quit pursuant to the laws of the Jurisdiction of [Jurisdiction].

NOW, THEREFORE, Landlord hereby demands strict performance of all obligations under the Master Lease and provides formal legal notice as set forth herein.

2. Operational Definitions

For the purposes of this Notice, the following terms shall have the meanings ascribed below, and such definitions shall apply equally to the singular and plural forms of the terms defined:

  1. "Cure Period" means the exact duration of thirty (30) business days commencing on the first business day immediately following formal service of this Notice upon Tenant.
  2. "Default" means the failure of Tenant to timely perform any monetary or non-monetary obligation under the Master Lease, specifically including the failure to pay rent when due.
  3. "Jurisdiction" means the state, county, or municipal governing authority of [State/Province], within which the Premises are situated and under whose statutory framework this Notice is legally operative.
  4. "Late Fees" means the contractual penalties assessed against Tenant pursuant to Section [Section Number] of the Master Lease as a direct consequence of delinquent rent payments.
  5. "Leasehold Estate" means the possessory interest granted to Tenant under the terms of the Master Lease.
  6. "Premises" means the real property, dwelling unit, and any associated fixtures, storage units, or parking spaces located at [Rental Property Address].
  7. "Rent" means the monthly financial consideration, inclusive of base rent, utilities, and mandatory maintenance fees, owed by Tenant to Landlord pursuant to the Master Lease.
  8. "Service" means the formal delivery of this Notice to Tenant via personal delivery, certified mail with return receipt requested, or statutory posting, executed in strict compliance with the laws of the Jurisdiction.

3. Substantive Terms & Obligations

  1. Monetary Default Acknowledgment. Tenant hereby acknowledges that Tenant is in direct material breach of the Master Lease by virtue of failing to pay Rent in the cumulative amount of [Total Unpaid Rent Amount] for the payment cycle(s) spanning [Unpaid Rental Periods].
  2. Accrual of Additional Charges. In addition to the principal past-due Rent, Tenant remains liable for Late Fees totaling [Late Fee Amount] and administrative costs totaling [Administrative Cost Amount], bringing the total monetary obligation required to cure this Default to [Grand Total Due].
  3. Duty to Cure or Surrender. Tenant is hereby put on formal notice that Tenant must either:
    • (a) Tender full payment of the [Grand Total Due] in certified funds, wire transfer, or other cleared payment method acceptable to Landlord; or
    • (b) Completely vacate, surrender, and yield up peaceful possession of the Premises to Landlord, removing all personal property and occupants.
  4. Performance Metrics. Performance under this Notice requires strict compliance with timeframes. Time is of the essence with respect to every provision of this Notice. Partial payments accepted by Landlord shall not constitute a waiver of Landlord's right to demand full payment or pursue legal eviction unless executed via a separate written waiver agreement signed by Landlord's authorized legal counsel.
  5. Representations and Warranties. Tenant represents that Tenant has received this Notice and understands the legal obligations contained herein. Tenant further warrants that no oral modifications, extensions, or understandings have been entered into regarding the payment of past-due Rent.

4. Default, Termination, and Remedies

  1. Classification of Breach. The failure of Tenant to pay Rent when due constitutes a material, non-waivable breach of the Master Lease and this Notice.
  2. Cure Period and Statutory Notice. Tenant is granted a period of thirty (30) business days from the date of proper Service of this Notice to fully cure the monetary Default outlined in Section 3.
  3. Failure to Cure. If Tenant fails to cure the Default by paying the full [Grand Total Due] within the thirty (30) business day Cure Period, the Master Lease shall automatically terminate by operation of law and the terms of this Notice, without the necessity of any further notice or demand by Landlord.
  4. Legal Recourse and Eviction Proceedings. Upon expiration of the Cure Period without full cure by Tenant, Landlord reserves the absolute and immediate right to:
    • (a) Institute formal unlawful detainer or summary eviction proceedings in the appropriate court of the Jurisdiction;
    • (b) Seek a judicial writ of restitution to forcibly remove Tenant and all occupants from the Premises;
    • (c) Sue for all past-due Rent, holdover damages calculated at [Holdover Per Diem Rate] per diem, legal fees, court costs, and accrued statutory interest; and
    • (d) Pursue any and all other civil remedies available at law or in equity.

5. Boilerplate Legal Provisions

  1. Severability. If any provision of this Notice is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable. The remaining provisions of this Notice shall remain in full force and effect and shall not be affected thereby.
  2. Entire Agreement. This Notice, together with the Master Lease, constitutes the entire understanding between the parties regarding the subject matter hereof and supersedes all prior oral or written negotiations, representations, understandings, or agreements.
  3. Force Majeure. Neither party shall be held liable for any failure or delay in performance under this Notice (excluding Tenant's monetary obligations to pay Rent) if such failure arises from acts of God, war, natural disasters, governmental restrictions, or other catastrophic events beyond the reasonable control of the affected party.
  4. Governing Law. This Notice, and all claims or disputes arising out of or relating to it, shall be governed by, construed, and enforced in accordance with the laws of the Jurisdiction of [Jurisdiction], without regard to its conflict of laws principles.
  5. Dispute Resolution and Forum Selection. Any legal action, proceeding, or arbitration arising out of this Notice or the Master Lease shall be brought exclusively in the courts of [County Name] County, [Jurisdiction], or through binding arbitration administered by [Arbitration Association Name] if mutually agreed upon in writing. Tenant hereby consents to the personal jurisdiction of such courts and waives any objection based on forum non conveniens.
