1. Informed Consent to Participate

1.2 The Participant voluntarily elects to participate in the Authorized Activity with full knowledge of the inherent risks, hazards, and potential for physical, psychological, or financial injury, loss, or damage.

2. Assumption of Risk

2.1 The Participant explicitly and freely assumes all risks associated with the Authorized Activity, whether known or unknown, foreseen or unforeseen, including but not limited to physical injury, property damage, illness, or economic loss.
2.2 The Participant warrants that they are in sound physical and mental health, possess the requisite fitness level or medical clearance to undertake the Authorized Activity, and have disclosed all relevant medical conditions, allergies, or physical limitations to the Company in writing prior to execution.

3. Release of Liability and Waiver of Claims

3.1 To the maximum extent permitted by New Zealand law, the Participant (for themselves, their estate, heirs, executors, and assigns) hereby releases, discharges, and holds harmless the Company, its directors, officers, employees, agents, contractors, and representatives from any and all liability, claims, demands, or causes of action whatsoever arising out of or related to any loss, damage, injury, or death sustained during, or as a result of, the Authorized Activity.
3.2 Note regarding ACC: The Participant acknowledges that where personal injury is covered by the Accident Compensation Act 2001 (ACC), the right to sue for compensatory damages is restricted under New Zealand law; however, this release applies to all non-ACC covered losses, property damage, and legal liabilities to the fullest extent lawful.

4. Indemnification Clause

4.1 The Participant agrees to indemnify, defend, and hold harmless the Company against any and all claims, liabilities, damages, judgments, costs, or expenses (including legal fees on a solicitor-client basis) incurred by the Company as a direct or indirect result of the Participant’s breach of this Agreement, willful misconduct, or gross negligence during the Authorized Activity.

5. Privacy Act 2020 & Information Consent

5.1 The Participant authorizes the Company to collect, store, use, and disclose their personal information (including sensitive health or background data) in accordance with the New Zealand Privacy Act 2020.
5.2 Personal information will be utilized solely for the administration of the Authorized Activity, emergency response management, and internal operational compliance.

6. Emergency Medical Treatment Authorization
