AIRBNB PROPERTY MANAGEMENT CONTRACT

THIS PROPERTY MANAGEMENT AGREEMENT (the “Agreement”) is entered into as of [Effective Date] (the “Effective Date”) by and between:

Owner and Manager may collectively be referred to as the “Parties” and individually as a “Party.”

1. RECITALS

WHEREAS, Owner holds legal title to the real property located at [Property Address] (the “Property”); WHEREAS, Owner desires to engage Manager to provide professional short-term rental management services for the Property via the Airbnb platform and other booking channels; WHEREAS, Manager represents that it possesses the requisite expertise, licenses, and infrastructure to operate the Property as a short-term rental; NOW, THEREFORE, in consideration of the mutual covenants contained herein, the Parties agree as follows:

2. OPERATIONAL DEFINITIONS

1. “Gross Revenue” means the total dollar amount collected from guests for bookings, including nightly rates and cleaning fees, but excluding taxes collected and remitted to authorities.
2. “Management Fee” means the commission percentage of [Percentage]% of Gross Revenue payable to Manager.
3. “Operating Expenses” means all costs associated with the maintenance, cleaning, supplies, and platform fees for the Property.
4. “Platform” means Airbnb, Inc., and any other third-party booking sites utilized by the Manager.
5. “Guest” means any individual or entity that enters into a rental agreement for the use of the Property.

3. SUBSTANTIVE TERMS & OBLIGATIONS

1. Scope of Services: Manager shall be responsible for: (a) creating and managing the online listing; (b) dynamic pricing optimization; (c) guest communication and vetting; (d) coordination of cleaning services; and (e) maintenance oversight.
2. Owner Representations: Owner represents that they have the legal right to lease the Property, that the Property is compliant with local zoning and short-term rental ordinances, and that the Property is covered by appropriate homeowner/landlord insurance.
3. Financial Accounting: Manager shall provide a monthly statement to Owner by the [Day] of each month, detailing all Gross Revenue and deductible Operating Expenses, accompanied by the remittance of net proceeds to Owner.
4. Performance Standards: Manager shall maintain a minimum average star rating of [Number] stars on Airbnb and respond to all guest inquiries within [Number] hours.
5. Insurance & Liability: Owner shall maintain comprehensive general liability insurance. Manager shall be named as an additional insured on the Property’s insurance policy, or alternatively, hold adequate professional liability insurance.

4. DEFAULT, TERMINATION, AND REMEDIES

1. Breach: A Party shall be in default if they fail to perform any material obligation under this Agreement.
2. Notice and Cure: In the event of a breach, the non-breaching Party shall provide written notice detailing the breach. The breaching Party shall have thirty (30) business days from the receipt of such notice to cure the default.
3. Termination for Cause: If a breach is not cured within the thirty (30) business day period, the non-breaching Party may terminate this Agreement immediately upon written notice.
4. Termination Without Cause: Either Party may terminate this Agreement with [Number] days’ prior written notice. Such termination shall not extinguish obligations for bookings already confirmed prior to the notice date.
5. Remedies: In the event of a breach, the non-breaching Party may seek damages, injunctive relief, or any other remedy available at law or in equity.

5. BOILERPLATE LEGAL PROVISIONS

1. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law principles.
