The tender of rent by the Tenant and its acceptance by the Landlord post-termination shall not constitute a waiver of this Notice nor create a new tenancy, but shall be deemed occupational rent.
  4. Joint Inspection Obligation: In compliance with the Rental Housing Act 50 of 1999, the Tenant and Landlord (or their duly authorized agents) shall conduct a joint outgoing inspection of the Premises prior to the Vacation Date at an agreed-upon time to assess the condition of the Premises and determine any deductions from the damage deposit held.
  5. Condition of Premises: The Tenant warrants and undertakes that upon vacating, the Premises shall be returned to the Landlord in the exact same clean, undamaged, and tenantable condition as received on the commencement date of the Lease Agreement, fair wear and tear excepted.

  2. Legal Proceedings for Eviction: The Landlord reserves the absolute and unfettered right to institute urgent legal proceedings in a court of competent jurisdiction (including the Magistrates' Court or High Court having jurisdiction over the area in which the Premises are situated) immediately upon the expiry of the Notice Period to obtain a formal Warrant of Ejection against the Tenant and all other occupants.
  3. Recovery of Legal Costs: In the event that the Landlord is forced to institute legal proceedings for eviction, recovery of arrear rentals, or damages, the Tenant shall be liable for and shall pay all legal costs incurred by the Landlord on the scale as between attorney and client, including collection commission, tracing fees, and counsel's fees on brief.
  4. Damages and Holding Over Penalties: The continued unlawful occupation of the Premises by the Tenant post-termination shall render the Tenant liable for the payment of monthly damages for holding over, calculated at an amount equal to [150% or Specific Multiplier] of the prevailing monthly Rental, payable in advance on the first day of each month, without prejudice to any other claims for damages the Landlord may suffer.
  5. No Prejudice to Rights: The issuance, delivery, or service of this Notice is without prejudice to any other legal rights, remedies, or claims which the Landlord may have against the Tenant arising out of the Lease Agreement or applicable South African law, all such rights being expressly reserved.

5. BOILERPLATE LEGAL PROVISIONS

  1. Severability: If any provision of this Notice is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remaining terms, and the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired thereby.
